PARTICIPANT’S RELEASE AND WAIVER OF LIABILITY AND INDEMNITY
Each person signing below (“you” or “your”) hereby acknowledges and agrees that your use of Hanna Center facilities, services, equipment or premises, involves risks of injury to persons and property, and you assume full responsibility for such risks. In consideration of being permitted to enter any facility of Hanna Center for any purpose including, but not limited to, observation, use of facilities, services or equipment, or participation in any way, you agree to hereby release, waive, discharge, covenant not to sue and hold Hanna Center and any of its present, former or future directors, officers, agents, employees, trustees, insurers, reinsurers, and representatives of any of them, harmless from all liability to you and your personal representatives, assigns, heirs, and next of kin for any loss or damage, and waive any claim or demands therefor, on account of injury to your person, or your property, including injury leading to death, whether caused by the active or passive negligence of Hanna Center or otherwise, while you are in, upon, or about Hanna Center premises or using any Hanna Center facilities, services or equipment. You also hereby agree to indemnify Hanna Center from any loss, liability, damage or cost Hanna Center may incur due to your presence in, upon or about the Hanna Center premises or in any way observing or using any facilities or equipment of Hanna Center, whether caused by your negligence, the negligence of Hanna Center, the negligence of a third party or otherwise. Such risk of injury includes (but is not limited to): injuries arising from use by you or others of Hanna Center’s facilities; injuries arising from participation by you or others in supervised or unsupervised activities or programs at Hanna Center’s premises; injuries and medical disorders arising from your participant in activities on Hanna Center’s premises such as heart attacks, strokes, heat stress, sprains, broken bones, and torn muscles and ligaments, among others; and accidental injuries occurring anywhere while on Hanna Center’s premises. You further expressly agree that the foregoing release, waiver and agreement is intended to be as broad and inclusive as is permitted by the law of the State of California and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full force and effect. You have had the opportunity to read this release and waiver of liability and indemnity clause, and agree that no oral representations, statements or inducement apart from the foregoing written agreement have been made.
